Terms of Hire By completing this form and clicking the submit button the hirer confirms that: They are over 18 and if representing a Company or Organisation, that they are authorised by their Company or Employer to enter into this agreement. By entering the Pyrotechnology invoice number and/or their Purchase Order Number when completing this form, the hirer agrees to pay the price quoted by Pyrotechnology Limited in accordance with the payment terms stated on the Pyrotechnology invoice and agrees that the hire term shall be as stated on the Pyrotechnology Invoice, the number of which is as entered by the hirer. The hirer also confirms that they agree personally and on behalf of the Company or Organisation they represent to be bound by the following terms and conditions of hire and by the general terms and conditions of trading of Pyrotechnology Limited. Where the hirer is not an approved account Customer of Pyrotechnology Limited the hirer agrees to supply a valid Credit or Debit Card account from which the hire fee and any required deposit may be taken at Pyrotechnology's option. 1. Use of the equipment hired under this agreement is entirely at the owner's risk. It is NOT covered by Pyrotechnology limited's Public Liability Insurance unless operated by a Pyrotechnology Ltd technician. 2. The hirer must not allow anyone under the age of 18 and/or anyone who has not been instructed in the safe use of the equipment to operate or use the equipment supplied under this hire agreement. 3. The Hirer agrees that they will at all times and in all respects indemnify Pyrotechnology Limited against any and all claims arising from the use or misuse of the equipment hired under this agreement by the hirer or their employees or by any third party howsoever caused. 4. Pyrotechnology Limited will make every effort to ensure that equipment arrives with the hirer on time and in good order and condition, but will not be held liable for any actual or consequential loss or damage either to the hirer or any third party whether for loss of profit, loss of business, costs, expenses or other claims for consequential compensation, damage personal or third party injury arising from either the use of the equipment hired from Pyrotechnology Limited or caused by any breakdown failure delay or stoppage of the Hire Equipment through any cause whatsoever, or from non-delivery or late delivery of equipment either by Pyrotechnology or its delivery agents or couriers. 5. Responsibility for the safe return of the Equipment in good order and condition to Pyrotechnology Limited is entirely the hirer's responsibility even when Pyrotechnology have agreed to provide courier or direct collection of hired equipment. 6. The hirer expressly agrees not to leave the Equipment unattended at any time and will not leave equipment at any venue for collection unless previously agreed with Pyrotechnology and in the care of a named member of staff at the venue. Repair & Replacement, Loss of Hire Equipment 7. The equipment Hired under this agreement is not insured by Pyrotechnology Limited for loss or damage while in the hirer's care or for loss or damage while in transit. 8. Where equipment or accessories are lost or are not returned within five working days of the end of the hire period, Pyrotechnology shall be paid within 7 days of raising an invoice to the hirer the full retail value of the equipment and any hire or replacement costs incurred by Pyrotechnology due to the equipment hired by the hirer not being returned on time. 6. The hirer agrees to pay all repair or replacement charges for Hire Equipment returned damaged and that these charges including any replacement parts required or where in the case of equipment damaged beyond economical repair that the replacement equipment will be charged at retail price. 7. The hirer agrees that all such charges for loss, damage or replacement, may be debited to the Credit or Debit Card account supplied by the customer when placing their order.
